In Quebec, it\u2019s estimated that one out of every three women has been the victim of sexual assault. Men are affected less often, but still aren\u2019t immune to it. Statistics indicate that at least one in every six men will be the victim of sexual assault at some point in his lifetime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The term <\/span><i><span style=\"font-weight: 400;\">sexual assault<\/span><\/i><span style=\"font-weight: 400;\"> encompasses several different offenses of a similar nature:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Indecent assault<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sexual exploitation<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sexual interference and invitation to sexual touching<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Harassment<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Indecent exposure<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Incest<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Voyeurism<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Child pornography<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Prostitution and solicitation, etc.<\/span><\/li>\n<\/ul>\n<h2>Accused, but not necessarily guilty<\/h2>\n<p><span style=\"font-weight: 400;\">Regardless of the circumstances, when you\u2019ve been <a href=\"\/en\/sexual-assault\/\">accused of assault<\/a>, you have the right to a full and complete defense. It\u2019s up to the court to determine if the Crown has established the burden of proof beyond a reasonable doubt.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Innocent people are sometimes falsely accused of assault. The presumption of innocence is one of the most important rights in the criminal justice system.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">This <\/span><b>presumption of innocence<\/b><span style=\"font-weight: 400;\"> implies the following:<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\"><b>That the accused doesn\u2019t have to prove that he or she is innocent.<\/b><span style=\"font-weight: 400;\"> It\u2019s up to the prosecutor representing the government (the \u201cCrown attorney\u201d) to prove to the court that the accused has perpetuated the crime.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>That the prosecution must prove that the accused is guilty \u201cbeyond a reasonable doubt.\u201d<\/b><span style=\"font-weight: 400;\"> If there isn\u2019t sufficient proof that the accused is guilty, he or she must be found not guilty.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>That the judge or jury must exercise impartiality.<\/b><\/li>\n<\/ul>\n<h2>If you\u2019ve been accused of assault, you have the following rights:<\/h2>\n<h3>To seek the help of a lawyer<\/h3>\n<p><span style=\"font-weight: 400;\">When you\u2019re arrested, you have the right to <a href=\"\/en\/contact-emergency\/\">speak with an attorney<\/a>. You can also choose to represent yourself, but if you do, you must be very familiar with, and abide by, all applicable regulations.<\/span><\/p>\n<h3>To be informed of any existing proof<\/h3>\n<p><span style=\"font-weight: 400;\">The ability to defend yourself adequately against the charges that have been brought is one of your fundamental rights. Therefore, you have the right to know all of the evidence that the prosecutor has gathered against you. The Crown attorney is required to disclose this information\u2014including the names of all the persons who will testify against you\u2014before the legal proceedings begin.<\/span><\/p>\n<h3>To remain silent<\/h3>\n<p><span style=\"font-weight: 400;\">You may choose to remain silent at each stage of the legal process, from the time of your arrest through the end of the proceedings. Furthermore, choosing to remain silent isn\u2019t tantamount to admitting guilt. The principle of this rule is based on the presumption of innocence mentioned above.
